Ortech markets the SOLO as achieving 15.5 SEER2 at over 12,000 BTU. The unit is manufactured by Nordica, and Nordica’s own published specifications do not support these claims. The advertised efficiency values are unsupported by any valid laboratory testing and are unlawful.
False and Unlawful Efficiency Representation
Federal law prohibits any efficiency or energy-use representation unless it is based on the DOE-prescribed test procedure. 42 U.S.C. § 6302(a)(5). When evaluated under 10 CFR Part 430, Subpart B, Appendix M1, the Ortech SOLO does not achieve the claimed 15.5 SEER2 at the advertised capacity.
Federal law further prohibits the distribution of covered products that are not properly certified or that do not conform to applicable energy conservation standards. 42 U.S.C. § 6302.
Non-Compliance and Consumer Harm
Because the Ortech SOLO does not meet its advertised efficiency rating—and because the claim contradicts the manufacturer’s own published data—the unit is non-compliant. Consumers pay higher electricity costs than they would have if the unit were accurately tested, lawfully rated, and honestly marketed.
